Oral appliance maker Panthera Dental and sleep diagnostic and therapy company ResMed have reached a settlement resolving patent infringement litigation over ResMed’s Narval CC nylon oral appliance for sleep apnea.

“We are pleased to announce that we have reached an amicable settlement with ResMed SAS that resolves all ongoing patent infringement litigation between Panthera and ResMed SAS in relation to our mandibular repositioning devices,” says Gabriel Robichaud, CEO of Panthera Dental, in a release. “We are very pleased with this agreement, which represents a positive outcome for Panthera.” 

Intellectual property is a critical component of the innovation that drives Panthera’s strategic development, Robichaud says, adding that this settlement is an important step in the company’s business growth. 

ResMed spokesperson Brad Lotterman says in an emailed statement, “We are pleased that patent litigation with Panthera, involving ResMed patents protecting our Narval product in Europe, has been amicably resolved by the parties through a confidential out of court settlement. With 35 years of innovation and more than 9,500 pending or issued patents and designs, ResMed is a leader in sleep therapy. We will defend our innovations to ensure patients continue to receive the high-quality care they expect from us.” 

In 2018, Narval CC was discontinued in the US market.
