A federal probe found that Rockefeller was exhausted from undiagnosed sleep apnea when he conked out and lost control of the train, reports New York Daily News.

Rockefeller, in the Manhattan Federal Court lawsuit, cited “the negligence of Metro-North, its agents . . . and employees” in the fatal crash.

A Metro-North spokesman, citing railroad policy, declined to comment on the lawsuit.
